Inceptive Education Site Terms

Please read site terms for Inceptive Education (“Inceptive”) before using this Platform. Inceptive’s Platform is available for your use only on the condition that you agree to the Site Terms (including Disclaimer and Privacy Policy) set forth below. If you do not agree, please don’t use or access our platform. By accessing or using Inceptive, you and the entity you are authorized to represent (“You” or “Your”) signify your agreement to be bound by the Site Terms.

For purposes of this Agreement, “Platform”, “Service” and “Program” refers to the Inceptive’s service which can be accessed via our website and related pages at http://www.inceptive.org/, https://inceptive.mn.co, and https://forum.inceptive.org/, through our mobile application, newsletter or digest and in-person workshops as well as webinars. The terms “we,” “us,” and “our” refer to Inceptive. “You” refers to you, as a user of Platform, Service or Product.

I. Disclaimer

1. Curated Content: The third-party resources including but not limited to ratings, reviews, images, articles, websites, services, graphics, products, blog posts, podcasts, videos and other audio-visual materials (“Curated Content”) made available or linked on Inceptive’s website, community forum and the newsletter (“Inceptive Platform”) are for general information purposes only. You understand that:

i. Curated Content is created, produced and/or made available by external parties (individuals, academic institutions, research organizations, nonprofits, and/or government bodies and so forth) and such external parties are not affiliated with Inceptive.

ii. Inceptive makes reasonable efforts to keep the information up to date and correct. However, Inceptive makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, availability or intellectual property rights with respect to the Curated Content.

iii. The inclusion of any Curated Content does not necessarily imply an opinion, advice, recommendation or endorsement of the views expressed within them. Any reliance you place on such information is therefore strictly at your own risk.

iv. Summaries of the Curated Content created by Inceptive are condensed versions of such Curated Content and not Inceptive’s opinions, recommendations, advice, or endorsement of any Curated Content.

v. Through the Inceptive Platform you are able to access Curated Content that is not under the control of Inceptive. Inceptive has no control over the nature, content and availability of those sites and Inceptive expressly disclaims any and all liability in connection with the Curated Content.

2. User Content: Inceptive allows posting and/or publishing by users of notes, questions, comments, ratings, reviews, images, articles, blog posts, podcasts, videos and other audio-visual materials (“User Content”) on its platform. However, you understand that:

i. Inceptive makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, availability, or intellectual property rights relating to such submissions. Any reliance you place on user content and submissions is therefore strictly at your own risk.

iii. You further understand and acknowledge that you may be exposed to User Content that is inaccurate, offensive, indecent or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Inceptive with respect it.

iii. Inceptive does not endorse any User Content or any opinion, recommendation or advice expressed therein, and Inceptive expressly disclaims any and all liability in connection with User Content.

iv. All User Content is subject to review and maybe published, taken down, or deleted at Inceptive’s sole discretion.

v. You and not Inceptive, are solely responsible for your User Content and the consequences of posting, creating, or publishing them. You represent and warrant that:

A. You are the creator and owner of or have the necessary licenses, rights, consents, and permissions to use and to authorize Inceptive and Inceptive’s users to use and distribute your User Content.

B. Your User Content does not and will not:

a. infringe, violate, or misappropriate any third-party rights, including but not limited to any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; or

b. slander, defame, libel, or invade the right of privacy, publicity or other property rights of any other person or organization; and
your User Content does not contain any viruses, adware, spyware, worms, or other malicious code.

a. infringe, violate, or misappropriate any third-party rights, including but not limited to any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; or

b. slander, defame, libel, or invade the right of privacy, publicity or other property rights of any other person or organization; and
your User Content does not contain any viruses, adware, spyware, worms, or other malicious code.

vi. Whether or not any User Content is published, Inceptive does not guarantee any confidentiality and fees or payments with respect to such User Content unless with a prior written agreement between the user and/or content generator and Inceptive.

vii. By posting, submitting or distributing User Content on or through the Inceptive Platform, you hereby grant Inceptive a worldwide, non-exclusive, transferable, assignable, fully paid-up, royalty-free, perpetual, irrevocable right and license to host, transfer, display, perform, reproduce, distribute, prepare derivative works of, use, make, have made, import your User Content, in whole or in part, in any media formats and through any media channels (now known or hereafter developed).

viii. By posting, submitting or distributing User Content through the Inceptive Platform, you hereby grant to each user of the Inceptive Platform a non-exclusive license to access and use User Content for a non-commercial use. However, Inceptive does not monitor or guarantee, nor is responsible for any unacceptable, unauthorized use of any User Content. Inceptive disclaims any and all liability with respect to any unauthorized, unacceptable access to and/or use of any User Content.

3. Original Content: The content created by Inceptive including but not limited to blog posts, articles, products, services, images, graphics, videos, podcasts, and other audio-visual materials (“Original Content”) is for general information purposes only. You understand that: 

i. The Original Content is a copyright material of Inceptive.

ii. Use of the Original Content for commercial use is strictly prohibited.

iii. The opinions, recommendations or advice expressed in the Original Content are that of the individuals, academic institutions, research organizations, nonprofits, and/or government bodies who wrote, spoke, interviewed or otherwise helped to create such Original Content. Any reliance you place on the Original Content is therefore strictly at your own risk. Inceptive expressly disclaims any and all liability in connection with the Original Content.

iv. Inceptive makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability of the Original Content.  

4. Donations and Fundraising: Inceptive as a nonprofit relies on donations to fund our programs and the operating costs. If you agree to support us using AmazonSmile you agree to the terms of Amazon.com, Inc. and its subsidiaries. If you chose to support us using our online and/or offline donation form:

i. You agree to provide your payment information at the time you fill the form. The payment will be collected at the time of the donation. The amount you donate is the amount you will be charged.

ii. You agree to provide Inceptive with a valid credit card (Visa, MasterCard, or any other issuer accepted by us) or PayPal account (“Payment Provider”).

iii. Your Payment Provider agreement governs your use of the designated credit card or PayPal account, and you must refer to that agreement and not these Terms of Use to determine your rights and liabilities.

iv. By providing Inceptive with your credit card number or PayPal account and associated payment information, you agree that Inceptive is authorized to immediately invoice your Account for all donations that you make to Inceptive and that no additional notice or consent is required.

v. You agree to immediately notify Inceptive of any change in your billing address or the credit card or PayPal account used for payment hereunder. Inceptive reserves the right at any time to change its billing methods, either immediately upon posting on the Site or by e-mail delivery to you.

vi. Inceptive reserves the right to cancel a donation at any time and for any reason.

5. General: Every effort is made to keep the Inceptive Platform up and running smoothly. However, you understand that:

i. Inceptive takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control. ii. In no event Inceptive will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of the Inceptive Platform.

ii. Inceptive is not a medical health provider and does not personally and individually evaluate patients. Inceptive is not liable for the outcome of any advice, tips, recommendations found offline or online through Inceptive and one of its affiliates and partners. Inceptive does not warrant that any advice found here could be applied successfully to a particular situation , nor is Inceptive liable for any damages or loss incurred related to any treatment performed based on the advice, guidance, tips obtained through the Service. Inceptive is under no obligation to become involved in disputes between any Users, Users and Medical Partners, or between Users and any third party, arising in connection with the use of the Service. You release Inceptive, its officers, employees, agents, and successors in rights from claims, damages, and demands of every kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and the Service. If you are a California resident, you hereby waive California Civil Code Section 1542, which states, “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him, must have materially affected his settlement with the debtor.


“THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” AND IS WITHOUT WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF TITLE, NON- INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES OR CONDITIONS IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. INCEPTIVE, AND ITS DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, PARTNERS, AND CONTENT PROVIDERS DO NOT WARRANT OR COVENANT THAT: (A) THE SERVICE WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) ANY CONTENT OR SOFTWARE AVAILABLE AT OR THROUGH THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK. SOME STATES OR COUNTRIES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY OR CONDITIONS LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

 

II. Privacy Policy

Inceptive is committed to protecting the privacy of its users. This Privacy Policy (“Privacy Policy”) is designed to help you understand what information we gather, how we use it, what we do to protect it, and to assist you in making informed decisions when using our Service.  Unless otherwise indicated below, this Privacy Policy applies to any website that references this Privacy Policy, any Inceptive website, as well as any data Inceptive may collect across partnered and unaffiliated sites. 

1. Consent: We respect the privacy of our visitors. We collect only such personal information as is needed to provide the information, service, or assistance that you request and improving Inceptive. By accessing our Service, you accept our Privacy Policy and Site Terms, and you consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. In addition, by using our Service, or services across partnered and unaffiliated sites, you are accepting the policies and practices described in this Privacy Policy. Each time you visit our website, or use the Service, and any time you voluntarily provide us with information, you agree that you are consenting to our collection, use and disclosure of the information that you provide, and you are consenting to receive emails or otherwise be contacted, as described in this Privacy Policy. Whether or not you register or create any kind of account with us, this Privacy Policy applies to all users of the website and the Service.

2. Information you provide us directly: If you create an account on Inceptive or sign up for our newsletter:

i. We may ask for certain personal information such as your username, real name, birthdate, address, phone number and e-mail address when you register for an account, or if you correspond with us.

ii. We may ask for non-personal information such demographic data. 

iii. We may retain any messages you send through Inceptive, and may collect information you provide in user content you post on Inceptive.

iv. We use this information to operate, maintain, and provide to you the features and functionality of Inceptive.

v. Your username and if you choose to disclose it, your real name, will be published publicly. Once published your username and/or real name may not be able to be removed.

vi. We will not sell, trade, rent or disclose this information to third parties, except for site security or law enforcement purposes and as specified in this Privacy Policy.

vii. If you request information, services, or assistance, we may disclose your personal information to those third parties that (in our judgment) are appropriate in order to fulfill your request. If, when you provide us with such information, you specify that you do not want us to disclose the information to third parties, we will honor your request. Note, however, that if you do not provide such information, it may be impossible for us to refer, respond to, or fulfill your request.

3. Information we collect automatically: If you visit Inceptive to browse, read, or download information:

i. Your web browser automatically sends us (and we may retain) information such as the:

A. Internet domain through which you access the Internet (e.g., yourServiceProvider.com if you use a commercial Internet service provider, or yourSchool.edu if you use an Internet account from your school);

B. Internet Protocol address of the computer you are using;

C. Type of browser software and operating system you are using;

D. Type of device you are using;

E. Date and time you access our site;

F. The Internet address of the site from which you linked directly to our site.

ii. We will use this information as aggregate data to help us maintain Inceptive, e.g., to determine the number of visitors to different sections of Inceptive, to ensure Inceptive is working properly, and to help us make Inceptive more accessible and useful.

iii. We will not use this information to identify individuals, except for site security or law enforcement purposes.

iv. We will not obtain personally-identifying information about you when you visit Inceptive, unless you choose to provide such information.

v. We will not disclose this information to third parties, except as specified in this Privacy Policy.

vi. If you request information, services, or assistance, we may disclose your personal information to those third parties that (in our judgment) are appropriate in order to fulfill your request. If, when you provide us with such information, you specify that you do not want us to disclose the information to third parties, we will honor your request. Note, however, that if you do not provide such information, it may be impossible for us to refer, respond to or fulfill your request.

4. Links to and embedded content from other websites: As a part of Inceptive, we provide links to other websites and applications. However:

i. We are not responsible for the information, contents and privacy practices employed by third party websites and applications. This Privacy Policy applies only to the information collected by us through Inceptive.

ii. This Privacy Policy does not apply to your use of a third party website or application accessed by selecting a link on Inceptive.

iii. To the extent that you access or use a third party website or application; or use Inceptive through or on another website or application, then the Privacy Policy of that other website or application will apply to your access or use of that website or application. We encourage you read the privacy policies of other websites or applications before using them.

5. Your rights regarding the use of your personal information: You control your account information and settings:

i. You may update your account information and email communication preferences at any time by logging into your account and changing your profile settings. You can also stop receiving promotional email communications from us by modifying your preferences at any time.

ii. We make every effort to promptly process all unsubscribe requests. However, you may not opt out of Service-related communications (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of Inceptive, legal, technical and security notices). If you have any questions about reviewing or modifying your account information, you can contact us or email directly to [email protected].

6. How long we keep information: 

i. We reserve the right to retain all information provided for as long as the information is needed.

ii. Following termination of your user account, Inceptive may retain your private profile information for a commercially reasonable time for backup, archival, or audit purposes. For the avoidance of doubt, any information that you choose to make public on the service may not be removable.

7. Security: The security of your personal information is important to us and we use commercially reasonable efforts and tools to preserve the integrity and security of all information collected through Inceptive. However, you understand that:

i. No method of transmission over the Internet, or method of electronic storage, is 100% secure and we cannot guarantee its absolute security. By using Inceptive, you acknowledge that you understand and agree to assume this risk.

ii. Please do not send sensitive data (e.g., Social Security, bank account, or credit card numbers) by email or web form unless necessary.

iii. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from Inceptive, at all times.

8. Cookies:

i. Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer’s hard drive. These Cookies are not required for site functionality.

ii. We may use Cookies to collect information and/or customize Inceptive for return visitors. Additionally, third-party widgets such as YouTube or Vimeo may install cookies, depending on their configuration.

iii. You may instruct your browser to refuse all Cookies or to indicate when a cookie is being sent. However, some features of Inceptive may not function properly if the ability to accept cookies is disabled.

9. Google Analytics:

i. We use a tool called “Google Analytics” to collect information about use of Inceptive.

ii. Google Analytics collects information such as how often users visit Inceptive, what pages they visit when they do so, and what other sites they used prior to coming to Inceptive.

iii. We use the information we get from Google Analytics only to improve Inceptive. Google Analytics collects only the IP address assigned to you on the date you visit Inceptive, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information.

iv. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit Inceptive, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to this site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to Inceptive by disabling cookies on your browser.

10. Email Communications & Opting Out:

i. We email a monthly digest that includes consolidated posts from that week.

ii. We may send you Service-related announcements on occasions when it is necessary to do so. For instance, if our Service is temporarily suspended for maintenance, or a new enhancement is released, which will affect the way you use our Service, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. Based upon the personal information that you provide us, we may communicate with you in response to your inquiries to provide the services you request and to manage your account. We will communicate with you by email or telephone, in accordance with your wishes.

iii. We may also use your personal information to send you updates and other promotional communications.

iv. If you no longer wish to receive weekly digest and/or email updates, you may opt-out of receiving them by following the instructions included in each update or communication.

11. Changes to this Privacy Policy:

i. We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically.

ii. Your continued use of Inceptive after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.

iii. If we make any material changes to this Privacy Policy, we will notify you either through the email address you have provided us, or by placing a prominent notice on our website.
